Terms & Conditions

These Terms & Conditions apply to all services provided by Creative Freedom Ltd. By engaging our services, you agree to the terms outlined below.



Acceptance

All work is carried out on the understanding that the client has accepted these Terms & Conditions.

A written quotation will be provided before work begins. Acceptance of the quotation, whether in writing or by proceeding with the project, confirms acceptance of these terms.



Fees and payment

All fees will be set out in the agreed quotation.

  • A deposit is required before work begins, typically 50 percent of the total project fee
  • The remaining balance is invoiced on completion
  • Final invoices are payable within 30 days

We reserve the right to pause work if payments are not received in accordance with these terms.

Late payments may incur interest at a rate of 2 percent per month on the outstanding balance.



Scope of work and additional services

The scope of work will be defined in the quotation.

Any work requested outside of the agreed scope will be quoted separately and must be approved before work proceeds.

Where appropriate, work may be paused until additional scope and costs are agreed.



Revisions and changes

Reasonable revisions are typically included as part of the design process.

Once a design direction has been approved, any significant changes or new directions may be treated as additional work and charged accordingly.



Delivery and formats

Final deliverables will be supplied in the formats agreed in the quotation or project specification.

Unless otherwise agreed, this may include standard formats such as SVG, PNG, or other commonly used file types.

Any additional formats, conversions, or technical adaptations requested after delivery may be treated as additional work.



Acceptance of deliverables

Upon delivery, the client is responsible for reviewing the work and confirming acceptance.

If no issues are raised within a reasonable period, the work will be considered accepted.

Any issues identified after acceptance may be treated as additional work.



Copyright and intellectual property

All design work, including concepts and draft materials, remains the property of Creative Freedom Ltd until full payment has been received.

Upon receipt of full payment:

  • full copyright for the final approved deliverables transfers to the client
  • unused concepts and draft work remain the property of Creative Freedom Ltd

Creative Freedom Ltd retains ownership of any pre-existing materials, methods, systems, and tools used in the creation of the work.



Client responsibilities

The client is responsible for ensuring that any materials supplied to Creative Freedom Ltd, including text, images, or other content, do not infringe the rights of any third party.

The client agrees to indemnify Creative Freedom Ltd against any claims arising from the use of such materials.



Portfolio and promotion

Creative Freedom Ltd reserves the right to display completed work in its portfolio and promotional materials, including on its website and social media.

If the client requires that work remains confidential or is not used for promotional purposes, this must be requested in writing before or during the project.

In the absence of such a request, Creative Freedom Ltd will assume permission has been granted.



Confidentiality

Any confidential information shared during the course of a project will be treated as confidential and will not be disclosed to third parties without consent, except where required by law.



Limitation of liability

Creative Freedom Ltd will provide its services with reasonable skill and care.

To the fullest extent permitted by law, our liability for any claim arising out of or in connection with the services provided shall be limited to the total fees paid by the client for the relevant project.

We shall not be liable for any indirect, consequential, or incidental losses.



Termination

Either party may terminate a project at any time by written notice.

In the event of termination:

  • the client will pay for all work completed up to the date of termination
  • any deposit paid is non-refundable


Force majeure

Creative Freedom Ltd shall not be liable for any failure or delay in performance resulting from events beyond its reasonable control, including but not limited to acts of God, natural disasters, war, illness, technical failures, or interruption of services.



Governing law

These Terms & Conditions are governed by the laws of England and Wales.

Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
